Reply : Advice not received is not a valid reason for returning a draft in India as it is a “value received” instrument. You can get redress by writing to the higher authorities of the branch. In the first instance, you should lodge your claim for the damages as perceived by you with the branch itself. A copy of this claim may be sent to the higher authorities of the Bank. Later, if no response is received, you should pursue your case with the higher authorities. Initially, there should be no need to send photocopies of the letter received from the branch. However, later you may have to produce that, so keep all the documents secure. If, as is most likely, you have to seek legal redress, you should prefer consumer forums as otherwise the legal recourse is quite expensive and Indian law does not have many earth-shaking precedents in the cases under law of torts.
