I have completed 4years 11 months service in my present company, suppose If I submit my resignation on beginining of 12th month ( ie. 4 Years 12 month) with 30 days notice, in this case I continue 30 days I will be eligible for Gratuity, however If my employee relieve before 30 days notice in that case I may not complete 5 Years complete period ..... in this instance what is my stand... .whether I can go legally and claim Gratuity based on 30 days Notice period ??
