1. Nomination becomes operative only after the death of all the depositors. Thus, if one of the depositor dies where the deposit is not payable to "anyone or survivor" then by law the surviving depositors and the legal heirs ofthe dead depositor are entitled to the deposit.
2. Nomination Rules do not overrule the subtantive law of the land. They merely discharge the bank paying according to the Nomination Rules. Thus, if before bank's paying to a nominee, legal heirs may make a claim to such deposit and the ve entitled to receive at following due process of sucession law.
