Subject: Consumer right on ATM Misuse
Message : Your query, in short is, is aimed to understand your rights and remedies in the situation of a transaction of atm cash withdrawal using your debit card, not done by you and also what to do further.

Let us analyze the transactions first.

Such transactions requires two things a) the card and b) code number relating to the card (pin, tin etc). Thus, someone in possession of both alone could have done this transaction.

Common experience is such transactions are done by someone at card holder's home or office or at the bank who is privy to both a) and b) above.

If the transaction has occurred not quickly after the issuance of the card then it is more likely that the wrongdoer is someone near to the card holder who can have had access to both a) and b)

The Terms and Conditions (or any other agreement) between the bank and the cardholder decide the rights and remedies of the cardholder. Normally such terms make the cardholder fully responsible for all transactions occurring on the card issued to him provided the card and the code number (pin/ tin etc) is received by the cardholder.

Thus unless non-receipt of the card or code number (pin/ in etc) is your case, you really do not have much case against the bank. However, it not being the case you may serve a notice and file a complaint with the Consumer Forum.
